Terms of service

These Terms of Service govern your use of acase.store (the Store) and purchases from Nikit Kamardins, an individual seller trading as ACASE LED (we, us, or our). By using the Store or placing an order, you agree to these Terms, the Refund and Return Policy, Shipping Policy, and Privacy and Cookie Policy.

1. Eligibility and Store Use

You must have legal capacity to enter a binding contract. If you are under the age of majority where you live, a parent or legal guardian must place the order. You must provide accurate, complete, and current information and use the Store only for lawful purposes.

2. Products and Information

We try to describe and display products accurately. Screen settings, lighting, photography, handmade or production variations, and material batches may cause reasonable differences in color or appearance. Measurements are approximate unless expressly guaranteed. A material difference from the description remains subject to mandatory consumer rights.

Product availability, specifications, packaging, included components, and pricing may change. We may correct typographical, pricing, inventory, or description errors before accepting an order. We do not guarantee that every product or feature will remain available.

3. Orders and Contract Formation

Your order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance. Unless mandatory law provides otherwise, we accept the order when we send a dispatch confirmation or otherwise expressly confirm acceptance.

Before acceptance and dispatch, we may reject, limit, or cancel an order for stock, pricing, payment, fraud, address, sanctions, customs, product-safety, shipping, legal-compliance, or geographic restrictions. If payment was captured for a cancelled order, we will issue a refund to the original payment method.

We may limit quantities per customer, household, payment method, or address and may refuse orders that reasonably appear to be fraudulent, abusive, unauthorized, intended for prohibited resale, or designed to evade Store controls.

4. Prices, Payment, Taxes, and Import Charges

Prices and currency are shown in the Store or at checkout. Shipping, taxes, duties, and other charges are included only when expressly stated. You authorize the applicable payment provider to charge the total shown at checkout.

International orders may be subject to import VAT, customs duties, brokerage, carrier handling, or other government charges. Where these are not collected at checkout and applicable law permits, the recipient is responsible for paying them. The existence of possible destination charges is also described in the Shipping Policy.

5. Order Changes and Cancellations

Contact contact@acase.store immediately to request a change or cancellation. We will try to help but cannot guarantee changes after processing begins. Once dispatched, the Refund and Return Policy applies. Nothing in this section limits a non-waivable statutory cancellation or withdrawal right.

6. Fulfillment, Shipping, and Delivery

Orders may be prepared and shipped by third-party international fulfillment partners. Dispatch origin, carrier, route, packaging, and delivery time may vary by product and destination. Estimated processing or delivery times are not guaranteed delivery dates unless expressly confirmed as such.

Shipping and delivery are governed by the Shipping Policy. Risk of loss transfers only when permitted by applicable law. For consumers in jurisdictions where risk remains with the seller until physical delivery, those mandatory rules apply.

7. Returns, Refunds, and Consumer Rights

The Refund and Return Policy forms part of these Terms. Except where mandatory law provides otherwise, we do not offer change-of-mind returns. Nothing in these Terms excludes a legal guarantee, conformity right, product-safety duty, withdrawal right, refund, repair, replacement, or other remedy that cannot lawfully be excluded.

8. Product Use and Safety

Follow all product instructions, labels, charging instructions, warnings, and care information. Inspect electrical, LED, cable, connector, controller, and battery components before use. Stop using and disconnect a product if it becomes unusually hot, emits an odor, sparks, swells, leaks, is wet where it should not be, or has damaged wiring or battery components.

Do not modify electrical components or use incompatible chargers or power sources. Keep products and small components away from children unless a product is expressly identified as suitable for them. Product-specific warnings and mandatory safety rights prevail over this general section.

9. Intellectual Property

The Store design, branding, text, graphics, logos, product presentation, photographs, videos, and other content are owned by or licensed to ACASE LED and are protected by applicable intellectual-property laws. You may not copy, scrape, reproduce, modify, publish, sell, or exploit Store content without permission, except as law permits.

10. Reviews and User Content

If you submit a review, image, video, comment, or other content, you confirm that it is truthful, lawful, based on genuine experience where represented as such, and does not violate another person's rights. You grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and adapt that content for operating and promoting the Store, subject to applicable privacy and consumer law.

We may moderate or remove content that is unlawful, irrelevant, abusive, misleading, fraudulent, or infringes rights. We do not promise to publish every submission and do not pay for positive reviews unless a disclosed promotion expressly states otherwise.

11. Prohibited Conduct

·       Interfering with Store security, operation, checkout, accounts, or networks.

·       Using false identity, payment, contact, delivery, or claim information.

·       Introducing malware, automated scraping, abusive traffic, or unauthorized code.

·       Using the Store for unlawful, fraudulent, infringing, or abusive activity.

·       Attempting to obtain goods, refunds, credits, or benefits through deception or duplicate claims.

12. Third-Party Services and Links

The Store may rely on or link to third-party platforms, payment providers, carriers, social media, or other services. Their separate terms and privacy practices may apply. We are not responsible for third-party services beyond responsibility that applicable law assigns to us as the seller.

13. Disclaimer

To the maximum extent permitted by law, the Store is provided on an as-available basis. We do not promise uninterrupted access, error-free operation, or that every display or estimated time will be exact. No disclaimer in these Terms applies where it would exclude a warranty, guarantee, duty, or remedy that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when the contract was made. Where liability may legally be limited, our aggregate liability relating to an order will not exceed the amount paid for the affected product.

Nothing limits liability that cannot legally be limited, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence where applicable, unsafe products where liability is mandatory, or non-waivable consumer rights.

15. Events Beyond Reasonable Control

We are not responsible for delay caused by events reasonably outside our control, including carrier disruption, customs holds, severe weather, natural disaster, conflict, public-authority action, widespread system failure, or supply-chain interruption. We will communicate material delays and provide cancellation or refund options where required by law.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Latvia, without depriving a consumer of mandatory protections or access to courts available under the law of the consumer's habitual residence. Before starting formal proceedings, please contact contact@acase.store so we can attempt to resolve the issue.

17. General Terms

If any provision is invalid or unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. We may assign these Terms as part of a genuine transfer or reorganization of the Store, subject to applicable law. You may not transfer your rights or obligations without permission where permission may lawfully be required.

18. Changes and Contact
